Cancellations, Refunds & Participation

​These are the terms (the “Agreement”)

that govern your attendance at and/or participation in a live Journaling Through event (the “Event”).

By registering for the Event you are agreeing to these terms, which form a legal contract between Journaling Through (“Journaling Through”, “we”, “us”, “our”), and the registered attendee and/or participant (“you”, “your”).

 

This Agreement is a binding contract between you and us, so please read it carefully.*

 

If you are registering on behalf of another it is your responsibility to ensure that the person attending is aware of these terms and accepts them, and by completing the registration you are warranting that you have made the attendee aware of these terms and that they have accepted these terms.

 

1. EVENT ADMISSION

Admittance. Your registration entitles you only to admittance to the Event. It goes without saying that any and all other costs associated with your attendance (including without limitation any travel and/or accommodation expenses) shall be borne solely by you and we shall have not liability for such costs. Most of our events or online, so please ensure that you have the correct internet connection and reliable hardware to participate. Desktop attendance is preferred over mobile to get the full experience. 

Termination. We are committed to providing a peaceful and harassment-free Event and we expect all attendees to behave appropriately and to treat everyone else at the Event with dignity and respect. You acknowledge that we reserve the right to remove you from the Event if we, in our sole discretion, consider your presence and/or behaviour to create a disruption or to hinder the Event and/or the enjoyment of the Event by other attendees or speakers.

Media. We reserve the right to use photographs and recordings of any Event attendee in our promotional materials and in the publishing of replay videos of any Wix calls. We value your privacy and will do our best to ensure that no distinguishing photographs or videos will be included in our promotional material before your explicit consent. 

Photography and Recording of Audio and Video. Photographs, short audio and video clips taken and recorded by you may be used for social media, blogging and press coverage of sessions. Without express, written permission from us, audio and video clips published must be non-contiguous clips of thirty seconds or less and photographs must not contain Event content or materials or other participants. You are able to include materials containing the hosts. Subject to the foregoing limitation, all audio and video recording of Event sessions is strictly prohibited.

 

Event Agenda. We try to avoid it, but sometimes plans have to change. Therefore, you acknowledge and agree that we, in our sole discretion, reserve the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, venue and time.

 

2. FEE(S)

Payment. The payment of the applicable fee(s) for the Event is due upon registration. If such payment is insufficient or declined for any reason we may refuse to admit you to the Event and shall have no liability in that regard. *

 

Taxes. The fee(s) may be subject sales tax, value added tax, or any other taxes and duties which, if applicable, will be charged to you in addition to the fee(s).

3. SUBSTITUTION AND CANCELLATION POLICY

All ticket sales are final and non-refundable. Though they are transferable. Please contact us if you need to transfer your ticket registration to another party. You may also request a recording of the session if it is available. In order to get the most out of the session, we do strongly suggest that you ensure your participation in the session. 

Refunds. Cancellations between 25-72 hours before the event may be transferred to a different date/time of the same topic if available. Cancellation requests made within 24 hours of the class date/time may not receive a refund nor a transfer. When you register for an event, you agree to these terms.

If, for whatever reason, Journaling Through or a co-host are unable o host the event, you will receive a full refund. 

4. PRIVACY POLICY

 

We are committed to protecting the privacy of our event attendees, clients, and customers. Your registration information is kept private and is used solely for the purposes of communicating with you about the Event and other related topics within the Journaling Through website.* You may receive emails from us on occasion as per the communication agreement pertaining to events. 

 

5. INTELLECTUAL PROPERTY

 

We have worked extremely hard to create and develop the workshops and all the content that you will receive at the Event. We of course want you to fully implement the content in your own personal and professional life, but we also want to remind you that all intellectual property rights in and to the Journaling Through, the Event, the respective co-hosts and the Event content and all materials distributed at or in connection with the Event are owned by Journaling Through and the co-host. You may not use or reproduce or allow anyone to use or reproduce, for any reason without our prior written permission: (i) any trademarks (including without limitation “Journaling Through or any course named ion the site”) or other trade names appearing at the Event; (ii) in any Event content; and/or (iii) in any materials distributed at or in connection with the Event. This means, among other things, that you cannot teach or train others in the Journaling Through methods or the Event content and all materials distributed at or in connection with the Event.

For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by us or grant to you any right or license to any other intellectual property rights of Journaling Through and their affiliates, all of which shall at all times remain the exclusive property of Journaling Through.

 

6. WARRANTIES AND LIMITATION OF LIABILITY

We will do our best to provide you with an excellent and positive experience, but we do not warrant or guarantee that any particular results will come from your attendance at the Event. You understand that implementation of the principles and tactics described during the Event is a highly individualized and subjective process that may lead to different results for different people; thus, we cannot guarantee that you will, for example, experience an increase in productivity or improved work-life balance. Individual experiences will vary.

We give no warranties in respect of any aspect of the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaim all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness and merchantability. We do not accept any responsibility or liability for reliance by you or any person on any aspect of the Event and/or any information provided at the Event.

 

Other than to the extent required as a matter of law, we shall not be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.

 

Our maximum aggregate liability for any claim in any way connected with therewith or this Agreement whether in contract, tort or otherwise (including any negligent act or omission) shall be limited to the amount paid by you to us under this Agreement to attend the Event.

On occasion, there might be times that the subject matter may be heavy, hard to deal with or bring up thoughts that need to be dealt with in a professional capacity. We are not licenced psychologists, medical or mental health professionals. These events are for personal growth and entertainment purposes only. You are responsible for YOU.  seek professional. help.  and recommend that, at any time you feel the need to delve deeper into certain aspects of your life, to 

 

7. GOVERNING LAW AND JURISDICTION

 

This Agreement shall be governed by the laws of Ontario, Canada, without regard to conflict of law principles, and the parties shall submit to the exclusive jurisdiction of the Ontario courts.
